Terms of Service

These Terms of Service (“Terms”) govern your use of Fetan SMS (“the app”, “we”, “us”, “our”) and related services operated in connection with pharma.org.et. By using the app or services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the app or services.

1. Description of service

Fetan SMS is an SMS management application for businesses. It parses bank transaction SMS, may forward payment notifications to contacts you configure, and provides transaction history and reports. Core features require a valid subscription when offered. A free trial or promotional access may be offered at our discretion.

2. Eligibility

You must be able to form a binding contract under applicable law to use the service. If you use the app on behalf of a business, you represent that you have authority to bind that business to these Terms.

3. Account and registration

• You agree to provide accurate registration information (for example, name and phone number).
• You are responsible for activity on your account and for keeping your device secure.
• You must not share credentials or attempt to use another person’s account without permission.

4. Subscription and payment

Subscription to Fetan SMS is paid by local Ethiopian bank transaction only. The app does not process payments inside the app and does not collect card numbers or other payment credentials. You pay through your bank (or your bank’s channels), then submit payment proof (for example, a screenshot) for verification as described in the app. Plans, pricing, and trial terms may change with reasonable notice where required by law.

5. Acceptable use

You agree to use the app only in compliance with these Terms and applicable laws (including telecommunications, privacy, and anti-spam rules). You agree not to:

• Use the app to send harassing, fraudulent, or unlawful messages, or to interfere with others’ networks or devices.
• Reverse engineer, decompile, or attempt to extract source code except where applicable law permits.
• Circumvent subscription, device verification, rate limits, or other security or technical measures.
• Use the app in any way that could damage, disable, or overload our systems or third-party services.

You are responsible for SMS and forwarding rules you configure (for example, recipients and message content sent through your device).

6. Intellectual property

Fetan SMS, its branding, and related materials are owned by Blue Tech and/or its licensors. We grant you a limited, non-exclusive, non-transferable license to use the app as installed from an authorized store or distribution channel, subject to these Terms. You may not copy, modify, distribute, sell, or lease the app or our services except as allowed by law or with our written permission.

7. Third parties

The app interacts with your mobile carrier, device, and bank SMS formats. We do not control banks or carriers and are not responsible for their services, fees, or message delivery. Bank names and message formats may change; parsing accuracy is not guaranteed for every message.

8. Disclaimer of warranties

The app and services are provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or free of harmful components.

9. Limitation of liability

To the fullest extent permitted by law, Blue Tech and its suppliers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or business opportunities, arising from your use of the app. Our total liability for any claim arising from these Terms or the service is limited to the amount you paid us for the service in the twelve months before the claim (or zero if no fees were paid). Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the maximum permitted by law.

10. Indemnity

You agree to defend and indemnify Blue Tech and its affiliates against claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the app, your violation of these Terms, or your violation of any third-party rights.

11. Suspension and termination

We may suspend or terminate access to the service if you breach these Terms, if we must comply with law, or for operational or security reasons. You may stop using the app at any time. Provisions that by their nature should survive (including intellectual property, disclaimers, limitation of liability, and governing law) will survive termination.

12. Changes

We may update these Terms. We will update the “Last updated” date above. If changes are material, we will provide notice as required by law or through the app or website. Continued use after changes become effective constitutes acceptance. If you do not agree, you must stop using the service.

13. Governing law

These Terms are governed by the laws of the Federal Democratic Republic of Ethiopia, without regard to conflict-of-law principles, except where mandatory consumer protections in your country apply.
